1. Scope of application
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.

2. Contractual partner, conclusion of contract, correction options
The purchase contract is concluded with maROCKn UG (haftungsbeschränkt) (registered address: Bellermannstr. 68, 13357 Berlin, GERMANY), acting as the authorized sales and fulfillment agent of AMUSE INC. (Tokyo, Japan).

By placing the products in the online store, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

3. Contract language, contract text storage
The language available for the conclusion of the contract is: English.

We save the text of the contract and send you the order data and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the Internet after the order process has been completed.

4. Terms of delivery
Shipping costs are added to the indicated product prices. You can find out more about the shipping costs on the corresponding page in the checkout or under “Shipping policy”. Delivery takes place exclusively via DHL, within Germany and other European countries.

It is not possible to collect the goods yourself.

5. Payment 
The following payment methods are available in our online store. Payments are processed via Shopify Payments (operated by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland). Various third-party payment services are integrated:

  • Shop Pay
  • Credit Card (Visa, Mastercard, American Express, Maestro)
  • Apple Pay

Your means of payment will be debited as part of the order process immediately after completion of the order.

6. Retention of title
The goods remain our property until full payment has been made.

7. Damage in transit
If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately via info@flow-merch.eu. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.

8. Warranty and guarantees
The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online store.

9. Liability
We shall always be liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents:

  • in the event of injury to life, limb or health
  • in the event of intentional or grossly negligent breach of duty
  • in the case of warranty promises, insofar as agreed
  • insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations (cardinal obligations) due to slight negligence on our part, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract. Otherwise, claims for damages are excluded.

10. Product Rights and Copyright
All products offered in this online store are officially licensed merchandise of AMUSE INC. (Tokyo, Japan). maROCKn UG (haftungsbeschränkt) has been entrusted by AMUSE INC. to handle the sales, distribution, and fulfillment of these licensed products within the European market.

All designs, logos, images, and related materials appearing on the products are protected by copyright, trademark, and other intellectual property rights owned or licensed by AMUSE INC. and the respective artists or bands. Any reproduction, modification, or commercial use of these materials without prior written consent from AMUSE INC. or the relevant rights holder is strictly prohibited. Unauthorized use of the protected designs will be prosecuted under civil and criminal law.

11. Dispute resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
